Yield & Spread is a Utah state non-profit 501(c)(3) organization, EIN: 86-2679720. Information concerning Yield & Spread including financial and charitable purposes may be obtained, without cost, by emailing us as rebecca@yieldandspread.org.
 

Please read these terms of use before accessing, using or obtaining any materials, information, and products in association with Yield & Spread. Our "Services" refers to any information contained on the Yield & Spread website, all educational and course materials, downloadable resources and tools, presentations, coaching, audits, and all other related content.
 

Disclaimer
Yield & Spread is not a registered investment adviser, legal or tax advisor, financial planner, or broker/dealer. The Services are provided for informational and educational purposes only and are not intended to substitute for individualized financial, legal, or tax advice.

Although we make reasonable efforts to ensure that the information provided through the Services is accurate and up to date, errors or omissions may occasionally occur.

Investing involves risk. Invest at your own risk. Yield & Spread does not guarantee any particular investment return or financial outcome. None of the Services constitutes a recommendation that any particular security, portfolio of securities, transaction, investment strategy, or financial decision is suitable for any specific person.

Limitations of Liability & Indemnification
You expressly understand and agree that Yield & Spread shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses resulting from the use of inability to use the Services. In no event shall Yield & Spread be liable for lost profits or any special, incidental, or consequential damages arising out of in connection with our site, the Services, or this agreement (however arising including negligence). 

You agree to indemnify and hold us harmless from any claim or demand including reasonable attorneys' fees made by any third party due to or arising out of your breach of this agreement or the document it incorporates by reference, or violation of any law or the rights of a third party. Your sole use of the Services is at your sole risk. 

The Services are provided on an "as is" and "as available" basis without any warranty or condition, express, implied, or statutory. Yield & Spread does not warrant that the Services will be uninterrupted, timely, or error-free. Yield & Spread does not warrant that the result that may be obtained in the use of services will be accurate or reliable. Yield & Spread does not warrant the quality of any products, Services, information, or other materials purchased or obtained by you through the Services will meet your expectations, or that any errors in the Services will be corrected.

Revisions
The Services could include technical, typographical, or photographic errors. Yield & Spread does not warrant that any of these materials are accurate, complete, or current. Yield & Spread may make changes to the materials contained on its website or within its courses at any time without notice. Yield & Spread does not, however, make any commitment to update the Services.

Yield & Spread is not responsible for the contents of any linked sites to its Services. The inclusion of any link does not imply endorsement by Yield & Spread of the site. Use of any such linked web site is at the user’s own risk.

User-Submitted Information
Some of our Services, including calculators, forms, spreadsheets, applications, and other tools, may allow you to enter or submit information. You are responsible for ensuring that information you provide is accurate and that you have the right to provide it. You should not submit information that you do not want Yield & Spread to receive or that you are not authorized to share. Yield & Spread may use information you provide to operate, maintain, improve, and provide the applicable Service, in accordance with these Terms and our Privacy Policy. We do not guarantee that any tool, calculator, spreadsheet, or other resource will be error-free or produce accurate or complete results, and you are responsible for reviewing and verifying any results before relying on them.


Third-Party Services
Yield & Spread may use or link to third-party websites, platforms, software, payment processors, and other services to provide or support the Services. These third-party services are outside of our control and may experience errors, outages, changes, or other issues that affect your use of the Services. Your use of third-party services may also be subject to their own terms, privacy policies, and other conditions.


Yield & Spread is not responsible for the availability, performance, content, security, or practices of third-party services. The inclusion of a link to a third-party website or resource does not imply endorsement by Yield & Spread. Your use of any third-party website or service is at your own risk.


Intellectual Property
All original content and materials provided through the Services, including but not limited to written content, videos, presentations, graphics, worksheets, templates, tools, calculators, spreadsheets, frameworks, course materials, and other resources, are the intellectual property of Yield & Spread or are used with permission and are protected by applicable intellectual property laws.


Yield & Spread may incorporate information, research, images, data, links, examples, or other resources created by third parties into the Services. When we use third-party materials, we will make reasonable efforts to identify and appropriately credit or source the original creator or source. Third-party materials remain the intellectual property of their respective owners and are subject to any applicable terms or licenses.


Except as expressly permitted, you may not copy, reproduce, distribute, publish, sell, license, modify, or commercially exploit Yield & Spread's original content or materials, or use them to create your own products, courses, services, or other commercial offerings without our prior written permission.


The Services is proprietary and may not be used, published, redistributed, or repurposed without the prior written consent of Yield & Spread.


Governing Law
These Terms and your use of the Services are governed by the laws of the State of Utah, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Services will be subject to the applicable courts located in Utah, unless otherwise required by law.

Course Terms

Please read the Yield & Spread Terms & Conditions in full before accessing, using, or obtaining any materials from The Learn to Invest & Build Wealth Course (“Course”). The Yield & Spread Terms & Conditions apply to your use of the Course and are incorporated into these Course-specific terms.


These additional Terms and Conditions apply specifically to your purchase, access, and participation in both the self-paced version of the Course and any live cohort of the Course. By purchasing, enrolling in, or participating in the Course, you agree to both the Yield & Spread Terms & Conditions and these Course-specific Terms and Conditions.


Course Access & Account
Your purchase of the Course includes lifetime access to the Course for as long as Yield & Spread remains in operation and continues to offer the Course. We intend for students to retain access for the lifetime of Yield & Spread and the Course, but continued access cannot be guaranteed if Yield & Spread ceases operations or is otherwise unable to maintain or provide the Course. Your Course access is personal to you and subject to these Terms and Conditions.


No Guarantee of Results
Yield & Spread does not guarantee any particular financial, investment, or other results from completing the Course. Your results will depend on your individual circumstances, decisions, actions, and other factors outside of our control. Investing involves risk, including the potential loss of money.


Responsibility & Individual Circumstances
The Course provides general educational information and is not individualized financial, investment, tax, or legal advice. You are responsible for determining whether any information, strategy, or action discussed in the Course is appropriate for your individual circumstances. You should consult a qualified professional regarding your specific situation when appropriate.

 

Course Intellectual Property & Limited License
All Course materials, including videos, workbooks, templates, downloads, presentations, and other content, are owned by Yield & Spread or used with permission and are protected by applicable intellectual property laws. Your purchase provides you with a limited, non-exclusive, non-transferable license to use the Course materials for your personal, non-commercial educational purposes. You may not copy, share, sell, redistribute, republish, modify, or use the materials to create or support your own products, courses, services, or commercial offerings without our prior written permission.


Non-Transferability & Account Sharing
Your Course enrollment and account are for your personal use only. You may not transfer your enrollment, share your login credentials, or provide access to the Course to another person. We reserve the right to suspend or terminate access if we determine that an account or Course access is being shared or misused.


Testimonials & Results
Any testimonials, examples, or statements about results shared in connection with the Course represent individual experiences and are not a guarantee that you will achieve the same or similar results. Results vary based on individual circumstances, effort, decisions, and other factors.


Consent to Share Feedback 
By providing feedback, testimonials, survey responses, screenshots, or other materials about your experience with the Course, you grant Yield & Spread permission to use that content for educational, promotional, or marketing purposes. This may include your name, likeness, business name, statements, or results you voluntarily share. We will not use your feedback in a manner that identifies you if you have specifically requested that it remain anonymous.


Participant Confidentiality
If you participate in a Course community, group, discussion, or other setting where you receive information about other participants, you agree to respect their privacy and keep their personal, financial, or other confidential information confidential. You may not share another participant's information without their permission.


Conduct & Termination
We reserve the right to remove a participant from the Course, community, or related programs and to terminate or restrict access, with or without notice, if we determine that the participant has engaged in disruptive, abusive, harassing, discriminatory, unlawful, or otherwise inappropriate conduct, misused Course materials or access, violated these Terms, or otherwise acted in a manner that threatens the safety or integrity of the Course or its participants.


Refunds & Cancellations
Refunds and cancellations are subject to the refund policy presented at the time of purchase. Unless otherwise stated in that policy, purchases are final. If a refund is available, the applicable refund terms and deadlines must be followed.


Third-Party Platform
The Course is hosted and delivered through Thinkific, a third-party platform. While Yield & Spread makes reasonable efforts to ensure that the Course is available and functions as intended, we do not control Thinkific or guarantee the availability, security, accuracy, or performance of its platform. Thinkific may experience outages, errors, technical issues, or changes that affect your access to or use of the Course. Your use of Thinkific is also subject to Thinkific’s own terms, policies, and conditions. Yield & Spread is not responsible for issues arising from Thinkific’s platform, including interruptions, errors, data loss, or changes to its services.


Changes to the Course & These Terms
Yield & Spread may update, modify, or discontinue portions of the Course or these Terms from time to time. We will make reasonable efforts to communicate material changes when appropriate. Your continued access to or use of the Course after changes take effect constitutes your acceptance of the updated Terms.

Audit Terms

Please read the Yield & Spread Terms & Conditions in full before purchasing or participating in the Financial Audit. The Yield & Spread Terms & Conditions apply to your use of Yield & Spread’s Services and are incorporated into these Financial Audit Terms.


These Financial Audit Terms provide the specific terms of the agreement between Yield & Spread (“Consultant”) and the individual purchasing the Financial Audit (“Client”). By purchasing or participating in the Financial Audit, Client agrees to both the Yield & Spread Terms & Conditions and these Financial Audit Terms.


Purpose of the Agreement
Client wishes to engage Consultant to provide the financial audit and consulting described in this Agreement. Consultant has agreed to provide the Financial Audit according to the terms of this Agreement.


Financial Audit
Consultant will provide Client with the following as part of the Financial Audit:

  • Client Intake Form

  • 90-minute first session

  • One week for review and intermediate steps

  • 60-minute second session

  • Personalized roadmap and go-forward plan

The Financial Audit is a one-time engagement. Unless otherwise agreed in writing, the Financial Audit does not include ongoing consulting or additional sessions beyond those listed above.


Location & Delivery of the Financial Audit
The Financial Audit will be delivered remotely through video calls, Google Docs, email, and other mutually agreed-upon digital tools. Client is responsible for providing accurate and complete information reasonably necessary for Consultant to conduct the Financial Audit.


Nature of the Relationship
The Financial Audit is a collaborative consulting engagement. Consultant will ask questions, review information provided by Client, identify opportunities and considerations, and provide observations, recommendations, and a personalized roadmap. Client understands that consulting is provided by permission and agrees to engage openly and honestly throughout the process. Client remains responsible for their own decisions and actions.


Financial & Investment Disclaimer
The Financial Audit is provided for educational and informational purposes only and does not constitute individualized investment, financial planning, legal, or tax advice. Consultant is not a registered investment adviser, broker-dealer, tax advisor, or financial planner. Consultant does not manage Client’s investments or make investment decisions on Client’s behalf. Any discussion of investments, strategies, accounts, tax considerations, or other financial topics is intended to provide general education and considerations for Client to evaluate. Client is solely responsible for their financial and investment decisions and should consult an appropriately qualified professional regarding their individual circumstances when appropriate. Investing involves risk, including the potential loss of money.


Client Responsibilities
Client is responsible for providing accurate, complete, and timely information and for actively participating in the Financial Audit. Client understands that the value of the Financial Audit depends in part on the information provided and the actions Client chooses to take. Consultant does not guarantee any particular financial outcome or result.


Confidentiality
Consultant will treat information provided by Client in connection with the Financial Audit as confidential and will not disclose it to third parties except as necessary to provide the Financial Audit, as required by law, or as otherwise described in the Yield & Spread Privacy Policy.


Intellectual Property
Consultant may provide worksheets, templates, forms, processes, frameworks, spreadsheets, and other materials as part of the Financial Audit. These materials are owned by Yield & Spread or used with permission and are provided for Client’s personal use only. Client may not copy, reproduce, distribute, sell, publish, or use these materials to create or support their own products or services without prior written permission.


Cancellation, Rescheduling & No-Shows
Client may reschedule the Financial Audit up to one (1) time with at least two (2) business days’ notice provided in writing. After one rescheduling request, or if Client fails to provide sufficient notice or does not attend a scheduled session, the session will be considered cancelled and will not be refunded. Any future Audits must be booked at the then-current rate.


Refund Policy
All Financial Audit purchases are non-refundable. By purchasing the Financial Audit, Client acknowledges and agrees to this refund policy.


Termination & Removal
We reserve the right to terminate the Financial Audit or remove Client from the engagement at any time, with or without notice, at our sole discretion. This may include termination for conduct that we believe is disruptive, abusive, inappropriate, or otherwise inconsistent with these Terms or the purpose of the Financial Audit. No refund will be provided in the event of termination or removal due to Client’s conduct or violation of these Terms.


Satisfaction & Feedback
Consultant wants Client to receive meaningful value from the Financial Audit. If Client has concerns about any part of the Financial Audit, Client agrees to communicate those concerns directly with Consultant so that Consultant has an opportunity to address them. Consultant may periodically ask Client to provide feedback or a testimonial about their experience. Any use of Client’s testimonial or identifying information will be subject to the applicable Yield & Spread Terms & Conditions.

Privacy Policy

Yield & Spread respects your privacy and is committed to protecting the personal information you provide to us. This Privacy Policy explains what information we may collect, how we use it, and the choices you have regarding your information.

For purposes of this Privacy Policy, “Services” refers to the Yield & Spread website, educational and course materials, downloadable resources and tools, presentations, coaching, audits, and other related content, as further described in our Terms & Conditions.

Our Values

Financial information is personal and private, and we take that responsibility seriously. We will only use or share your information as reasonably necessary to operate and improve our website, tools, programs, and Services, to provide services you have requested, or as otherwise described in this Privacy Policy. We do not sell or rent your personal information, and we will never share it for purposes unrelated to providing, supporting, or improving our Services without your permission, unless required or permitted by law.

Information We Collect
We may collect information you voluntarily provide to us, including your name, email address, contact information, information submitted through forms or applications, information provided when purchasing or participating in our programs, and other information you choose to provide. Depending on the Service you use, this may include financial or other personal information necessary to provide that Service.


We may also automatically collect certain information when you visit our website or use our Services, such as your IP address, browser type, device information, pages visited, and other usage information. We may use cookies, analytics tools, and similar technologies to help us understand how our website and Services are used and to improve them.

The FI-lanthropy Pledge & Giving What We Can

Yield & Spread promotes The FI-lanthropy Pledge in partnership with Giving What We Can (“GWWC”) as a way for individuals pursuing financial independence to incorporate charitable giving into their financial plans.

Participation in The FI-lanthropy Pledge is voluntary. Taking or participating in the pledge does not create a financial, investment, tax, or legal advisory relationship with Yield & Spread.

The FI-lanthropy Pledge may involve third-party services, websites, or platforms operated by GWWC. Your use of GWWC’s services is subject to GWWC’s own terms, policies, and conditions.
